1. Introduction

Welcome to Scorpion King Real Estate (“we,” “us,” “our,” or “the Company”). These Terms and Conditions (“Terms”) govern your access to and use of our website, services, and real estate brokerage activities in Dubai, United Arab Emirates.​

By accessing our website or engaging our real estate services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.​

2. Definitions

“Client” means any individual or entity that engages our real estate brokerage services.​

“Property” means any real estate property listed, marketed, or transacted through our services.​

“Services” means all real estate brokerage, consulting, property management, and related services provided by Scorpion King Real Estate.​

“Website” means scorpionkingre.ae and all associated subdomains and platforms.​

“RERA” means the Real Estate Regulatory Agency of Dubai.​

“DLD” means Dubai Land Department.​

“Agreement” means any contract, form, or binding arrangement between the Client and Scorpion King Real Estate.​

3. Eligibility and Registration

3.1 Age Requirement

You must be at least 18 years of age and legally capable of entering into binding contracts under UAE law to use our services.​

3.2 Account Creation

When registering for an account or subscribing to our services, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials.​

3.3 Prohibited Users

We reserve the right to refuse service to anyone who violates these Terms or engages in fraudulent, illegal, or harmful activities.​

4. Real Estate Services

4.1 Scope of Services

Scorpion King Real Estate provides the following services:​

  • Property buying and selling brokerage

  • Property leasing and rental services

  • Property management

  • Investment consulting and advisory

  • Market analysis and valuation assistance

  • Transaction facilitation and documentation support

  • Relocation assistance for international clients

4.2 Agency Relationship

When you engage our services, an agency relationship is established as per RERA regulations. This relationship may be exclusive or non-exclusive as specified in the signed agreement.​

4.3 RERA Compliance

All our real estate agents are licensed and registered with RERA. We operate in full compliance with Dubai Land Department regulations and UAE Federal Law No. 26 of 2007 (Regulating the Relationship Between Landlords and Tenants in the Emirate of Dubai).​

4.4 Required Forms

Property transactions may require completion of official RERA forms including:​

  • Form A: Broker’s Contract Agreement/Listing Form

  • Form B: Buyer’s Agent Agreement

  • Form I: Agent to Agent Agreement

  • Leasing Form: Leasing Agreement Contract

  • Tenancy Contract: Rental agreement

5. Commission and Fees

5.1 Commission Structure

Our commission rates are clearly stated in the signed agency agreement and comply with standard Dubai real estate practices. Typical commission structures include:​

  • Property Sales: 2% of the transaction value (negotiable)

  • Property Leasing: 5% of annual rent (standard practice)

  • Property Management: As specified in management agreement

  • Consultation Fees: As agreed in service contracts

5.2 Payment Terms

Commission and fees are payable upon successful completion of the transaction or as specified in the service agreement. All fees are exclusive of applicable VAT.​

5.3 Refund Policy

Fees are non-refundable once services have been rendered, except where explicitly stated in the service agreement or required by law.​

6. Client Obligations

6.1 Accurate Information

Clients must provide accurate, complete, and truthful information regarding property details, financial status, identification documents, and all matters relevant to the transaction.​

6.2 Property Access

Property owners must provide reasonable access to the property for viewings, inspections, and marketing purposes.​

6.3 Documentation

Clients must provide all necessary documentation including title deeds, NOCs (No Objection Certificates), identification documents, and authorization letters as required.​

6.4 Good Faith

Clients must act in good faith and not engage in parallel negotiations with other agents during an exclusive agency period.​

7. Our Obligations and Disclaimers

7.1 Professional Standards

We commit to providing professional, ethical, and competent real estate services in accordance with RERA standards and UAE laws.​

7.2 Marketing and Advertising

We will market properties through approved channels and platforms as agreed with the client, ensuring compliance with DLD advertising regulations.​

7.3 Limitation of Liability

While we exercise due diligence, we do not guarantee:​

  • Property valuations (which are estimates based on market conditions)

  • Future property appreciation or rental yields

  • Financing approval from banks or lenders

  • Specific transaction timelines

  • Third-party services (developers, contractors, property managers)

7.4 No Warranties

Properties are marketed “as is” based on information provided by owners. We are not responsible for undisclosed defects, structural issues, or misrepresentations by property owners unless we had actual knowledge of such issues.​

7.5 Investment Disclaimer

Past performance and historical data do not guarantee future results. All property investments carry inherent risks. Clients should conduct independent due diligence and seek professional legal and financial advice.​

8. Website Use

8.1 License to Use

We grant you a limited, non-exclusive, non-transferable license to access and use our website for personal, non-commercial purposes related to property search and real estate services.​

8.2 Prohibited Activities

You may not:​

  • Use the website for any illegal purposes

  • Attempt to gain unauthorized access to our systems

  • Scrape, harvest, or extract data from the website

  • Upload malicious code or viruses

  • Impersonate others or misrepresent your affiliation

  • Use automated systems or bots without permission

  • Reproduce, duplicate, or copy content without authorization

  • Interfere with the proper functioning of the website

8.3 User-Generated Content

If you submit content (reviews, comments, inquiries), you grant us a non-exclusive, royalty-free license to use, reproduce, and display such content. You represent that you own or have rights to any content you submit.​

Property listings, prices, availability, and descriptions are subject to change without notice. We make reasonable efforts to ensure accuracy but do not guarantee that all information is current or complete.​

9. Intellectual Property

9.1 Ownership

All content on our website, including text, graphics, logos, images, videos, and software, is the property of Scorpion King Real Estate or our licensors and is protected by UAE and international intellectual property laws.​

9.2 Trademarks

“Scorpion King Real Estate” and associated logos are our trademarks. You may not use our trademarks without prior written permission.​

9.3 Property Images

Property images and marketing materials are provided by property owners or developers. We do not claim ownership but have limited rights to use them for marketing purposes as authorized.​

10. Privacy and Data Protection

Your personal information is collected, processed, and stored in accordance with our Privacy Policy and applicable UAE data protection laws. By using our services, you consent to such processing.​

11.1 External Links

Our website may contain links to third-party websites (property portals, developers, mortgage providers). We are not responsible for the content, policies, or practices of external sites.​

11.2 Third-Party Services

We may coordinate with third-party service providers including mortgage brokers, lawyers, property managers, and developers. We are not liable for the actions, errors, or omissions of these third parties.​

12. Termination

12.1 By Client

Clients may terminate service agreements as specified in the signed agreement, subject to any notice periods and obligations already incurred.​

12.2 By Us

We reserve the right to terminate or suspend services immediately if you:​

  • Breach these Terms

  • Provide false or misleading information

  • Engage in fraudulent or illegal activities

  • Fail to make required payments

  • Act abusively toward our staff or agents

12.3 Effect of Termination

Upon termination, all outstanding fees become immediately due. Confidentiality obligations and liability limitations survive termination.​

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the United Arab Emirates and the Emirate of Dubai.​

13.2 Jurisdiction

Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.​

13.3 Mediation

Before initiating formal legal proceedings, parties agree to attempt good-faith mediation to resolve disputes.​

13.4 RERA Complaints

Disputes related to real estate brokerage services may be referred to RERA’s complaints and dispute resolution mechanism.​

14. Indemnification

You agree to indemnify and hold harmless Scorpion King Real Estate, its officers, employees, and agents from any claims, damages, losses, or expenses arising from:​

  • Your violation of these Terms

  • Your violation of any laws or regulations

  • Your violation of third-party rights

  • Misrepresentations or false information provided by you

  • Your use of our services or website

15. Limitation of Liability

15.1 Direct Damages

To the maximum extent permitted by UAE law, our total liability for any claims arising from these Terms or our services shall not exceed the total fees paid by you to us in the 12 months preceding the claim.​

15.2 Indirect Damages

We shall not be liable for indirect, incidental, consequential, special, or punitive damages including loss of profits, business interruption, or lost opportunities.​

15.3 Force Majeure

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control including natural disasters, government actions, pandemics, or technical failures.​

16. Confidentiality

16.1 Confidential Information

We agree to keep confidential all non-public information obtained from clients during the course of our services, except as required by law or authorized by the client.​

16.2 Permitted Disclosures

Confidential information may be disclosed to:​

  • Potential buyers or tenants (with client authorization)

  • Professional advisors (lawyers, accountants)

  • Regulatory authorities (RERA, DLD)

  • Third-party service providers (with appropriate confidentiality agreements)

17. Anti-Money Laundering Compliance

We comply with UAE anti-money laundering regulations and may require additional identification and verification documents. We reserve the right to refuse services if we suspect fraudulent or illegal activities.​

18. Electronic Communications

18.1 Consent

By using our services, you consent to receive electronic communications from us including emails, SMS, WhatsApp messages, and website notifications.​

18.2 Opt-Out

You may opt out of marketing communications at any time but cannot opt out of transactional or service-related communications.​

19. Amendments

19.1 Right to Modify

We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated “Last Updated” date.​

19.2 Notice

Material changes will be communicated via email or prominent website notice. Your continued use of our services after changes constitutes acceptance.​

19.3 Service Agreements

23. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms to any successor or affiliate.​

24. Language

These Terms are prepared in English. In case of translation into other languages, the English version shall prevail in case of any discrepancies.​

26. Acknowledgment

By using our website or services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
